Affiliate program terms

These terms govern the Ditty City affiliate program (the "Program"). By applying to or taking part in the Program you agree to them. They are in addition to our terms of service and privacy policy. Where these terms and the main terms of service conflict, these terms apply to your participation in the Program.
1. Eligibility
- You must be aged 18 or over.
- You apply at dittycity.com/affiliate. Applications are reviewed and are not accepted automatically. Until we approve you, your application status is "pending" and you cannot earn commission.
- You must give a real name, a working email address, and a PayPal address to be paid to.
- Employees and contractors of Ditty City, and members of their households, are not eligible to earn commission.
- You take part as an independent third party. Nothing here creates an employment, agency, partnership, or joint-venture relationship, and you must not present yourself as any of those.
2. Your link and how referrals are tracked
- On approval you get a unique referral link containing your affiliate code.
- When someone arrives through your link we store a cookie on their device for 30 days. If they buy within that window, the sale is attributed to you.
- Attribution depends on that cookie. If the customer clears their cookies, uses a different device or browser, or arrives later through someone else's link, the sale may not be attributed to you. We do not pay commission on sales we cannot attribute.
- A customer can only be referred once, and one referral applies per order.
3. Commission
You earn 20% of the amount the customer actually pays for a qualifying song, excluding any tax, shipping-equivalent, or third-party fees.
Read this part carefully. Customers arriving through your link get 20% off their first song. Your 20% is calculated on the discounted amount they pay, not on our list price. So the discount that helps you convert also reduces the base your commission is calculated on.

- Commission is earned only on a completed, paid order. Free songs, vouchers redeemed at $0, and refunded orders do not earn commission.
- Amounts are in US dollars. If we pay you in another currency, the conversion rate and any fees are those applied by the payment provider at the time of payout.
- Prices and the commission rate can change. See section 9.
4. Payout
- Commission is held for 14 days after the sale. This covers our refund window.
- After the 14-day hold, the commission becomes payable.
- We pay out once a month, on or around the 1st. A commission is included in a payout run only if it has already cleared its 14-day hold when that run happens. If it clears after the run, it goes out in the next one.
- Worked example. A sale on 28 July clears its 14-day hold on 11 August. That is after the 1 August run, so it is paid in the run on or around 1 September. A sale on 10 July clears on 24 July and is paid on or around 1 August.
- “On or around” is honest rather than vague: payouts are made by a person, so a run may land a day or two either side of the 1st, and weekends and bank holidays can move it. Depending on when in the month you make a sale, expect roughly 2 to 7 weeks between the sale and the money arriving.
- We pay by PayPal, to the address on your application. Keeping that address correct and working is your responsibility.
- If an order is refunded, cancelled, or charged back during the hold, the commission on it is voided. If a refund happens after we have already paid you, we may deduct the amount from your next payout.
- Minimum payout: $10. If your payable balance is under $10 at a payout run we hold it and roll it forward — it is never lost, and it goes out with the next run once the balance clears $10. This keeps small payments from being eaten by transfer fees.
- Payouts are made manually by us, not automatically.
- We may withhold a payout while we investigate a suspected breach of these terms.
5. Disclosure: you must label your links as advertising
This is a paid commercial relationship, and the law in most countries requires you to say so.
- You must clearly and conspicuously disclose that your links are advertising, wherever you share them: #ad, "paid link", "affiliate link", or the equivalent required where you are.
- The disclosure must be visible without clicking "more", scrolling past the link, or opening a description. Burying it in a bio, a hashtag wall, or a linked page does not count.
- You are responsible for following the rules that apply to you, including the US FTC Endorsement Guides and, in the UK, the CAP Code and the ASA's guidance.
- Failing to disclose is a breach of these terms and can void unpaid commission (section 8).
6. Prohibited conduct
The following void unpaid commission and may end your participation:
- Self-referral. Buying through your own link, or referring your household. Orders where the buyer's email matches the affiliate's are not commissionable.
- Bidding on our brand. Paid search on "Ditty City" or close variants, on any platform.
- Incentivised traffic. Cashback, "get paid to", or reward sites, or any arrangement where the customer gets extra consideration beyond the published discount.
- Spam. Unsolicited email or SMS, forum spam, comment spam, or social-media spam, or anything prohibited by the CAN-SPAM Act, PECR, or UK/EU GDPR.
- Misrepresentation. Posing as Ditty City, promising things we do not offer, inventing prices or guarantees, or claiming a song is human-made. Our songs are AI-written and AI-sung, and you must not say otherwise.
- Trademark or domain misuse. Registering domains containing "dittycity" or close variants, or using our name or brand in a way that suggests a relationship that does not exist.
- Harmful placement. Promoting Ditty City on sites containing adult, hateful, or illegal material, or content directed at children under 13.
- Faking demand. Bot traffic, click fraud, or artificially generated orders.
7. Tax
Commission may be taxable income in your hands. We do not deduct tax at source. You are responsible for declaring and paying any tax due on what you earn. If you are unsure, speak to a tax adviser. We will provide a summary of what we have paid you on request.
8. Suspension and termination
Either of us can end your participation at any time. You can stop simply by not using your link. We may suspend or end your participation, with or without notice, if we reasonably believe you have breached these terms, acted fraudulently, or damaged the Ditty City name. On termination for breach, unpaid commission earned in connection with that breach is forfeit. Commission earned in good faith before the breach will still be paid.
9. Changes to the Program
We may change the commission rate, the hold period, the eligible products, or close the Program. We will give you 30 days' notice by email to your registered address before a change that reduces what you earn. Commission already earned but not yet paid will be honored at the rate in force when the sale happened. If we update these terms, we will ask you to accept the new version, and we record which version you accepted.
10. Liability
The Program is provided as-is. We do not guarantee any level of traffic, conversion, or earnings, and nothing here is a promise of income. To the extent the law allows, our total liability to you in connection with the Program is limited to the commission properly owed to you at the time the claim arises.
11. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere, this does not remove any protection you have under the mandatory law of your country of residence.
